US Marshals Raid New Jersey Peanut Distributor

Believe it or not, the peanut product recalls from the PCA salmonella outbreak are not over yet; and one Irvington, NJ-based distributor has been hiding (literally!) from the FDA's attempts to make contact with the company and recall their products.  From a great write-up at Bill Marler's blog -

A federal official said Moradi [Westco/Westcott] "ran away and hid" when government inspectors showed up at his plant. Moradi acknowledged hiding from FDA inspectors but said it was because they had repeatedly visited him and staked out his plant, and he was frightened.

The company is Westco Fruit & Nut, operating out of a Coit Street location in Irvington, NJ.  The company sent out mixed nut products and trail mix containing peanuts from PCA's Blakely, Georgia plant up until February 2009, and FDA is warning people to dispose of all products containing peanuts they may have from Westco/Westcott Fruit & Nut Company.

Westco/Westcott refused to cooperate with FDA in the recall attempt or provide any information to federal investigators, so today US marshals raided their building -

At the request of the U.S. Food and Drug Administration, U.S. Marshals today executed an inspection warrant at Westco Fruit and Nuts Inc. (Westco/Westcott), an Irvington, N.J.-based company. Westco/Westcott did not provide access to distribution documents and declined to recall products after an FDA request.

There's that 'voluntary' recall system in action.  I guess the 'honor system' doesn't work when some companies are still willing to put profits before health, even if it risks potentially killing people...

I spent almost half of my working life in New Jersey (environmental remediation) doing clean-up jobs on and around Coit Street in Irvington.  So I have this really amusing image of the guy ducking behind weeds in the rear of some abandoned property near the railroad tracks there, or near I-78, hiding from the inspectors.  Just hope he didn't pick any wild greens or eat anything out of the ground there while he was hiding out...

Heh.  Sadly, sometimes the state where I was born and raised does live up to its stereotypes!  CEOs hiding in the weeds from the feds, and shit...

The honor system is ludicrous, won't work. (4.00 / 4)
This I got from the CSPI this morning:

FDA is being proactive, initiating the recall and working with Setton Farms to get potentially harmful products off the market even before any illnesses have been reported.  But the agency didn't act fast enough to prevent the eight other outbreaks from peanuts or mixed nuts since 2001.

The agency should not go company-by-company when it is clear that process controls are warranted for the nut industry overall.   Other nut processors may be making the same mistakes that resulted in the Setton plant and the Peanut Corporation of America shipping millions of pounds of tainted nuts across the country.  

FDA officials say they intend to issue "guidance" to the pistachio industry, but this is an inadequate response. Guidance is voluntary; regulations are law.  We can't rely on industry honor systems to protect us. Without mandates and enforcement, Americans' protection from food safety illnesses and future scares is paper thin.
